Gîtes de La Vironne - Booking Conditions

The property known as Gites de La Vironne ("the property") is offered for holiday rental subject to confirmation by Keith and Bronya Fitzsimmons ("the owner") to the renter ("the client").

Reservations

• To reserve the "property" the Client should complete and sign the booking form and return it together with payment of the initial non-refundable deposit (50% of the total rent due). Following receipt of the booking form and deposit, the Owner will send confirmation; this is the formal acceptance of the booking.
• Reservations made within eight weeks of the start of the rental period require the total rental sum together with the security deposit upon booking.
• The down payment of 50% of the total rental sum is non-refundable.
• The maximum number to reside in the Property must not exceed seven.
• We reserve the right to amend holiday prices at our own discretion

Rental - balance and liability for other payments

• The full rental balance, together with the security deposit, is payable not less than eight weeks before the start of the rental period.
• If payment is not received by the due date, the Owner reserves the right to give notice in writing that the reservation is cancelled. The Client will remain liable to pay the balance of the rent unless the Owner is able to re-let the Property. Any expenses or losses incurred in doing so will be deducted from the refundable amount.
• In case you cancel your booking we reserve the right to retain the rental paid and we shall under all circumstances be entitled to re-rent the property.

Security deposit

• A security deposit of £100.00 per gite per rental period is required in case of, for example, damage to the property and/or any of its contents, appliances, furniture and inventory. However, the sum reserved by this clause shall not limit the Client's liability to the Owner. The owner will account to the Client for the security deposit and refund the balance due within two weeks after the end of the rental period.

The Property

Arrival and departure

Rental periods commence and terminate on Saturdays

• The rental period shall commence at 4.00pm on the first day and end at 10.00am on the last day.
• The Owner shall not be obliged to offer the accommodation before the time stated and the client shall not be entitled to remain in occupation after the time stated.
• You will receive the key to the gite upon arrival.

Your stay

• Upon arrival at the property you should check the inventory and ascertain the proper functioning of equipment and machinery. You can inform the Owner of any missing objects, damage or malfunctioning within 1 hour from arrival. All efforts shall be made within reason to repair problems or inconveniences.
• The client agrees to be a considerate tenant, take good care of the Property and leave it clean and tidy at the end of the rental period. Although a final clean is include in our prices, the Owner reserves the right to make retention from the security deposit to cover additional cleaning costs if the Client leaves the Property in an unacceptable condition.
• The client shall not act in a way that would cause disturbance to those resident in neighbouring properties.

Pets

• Pets are not welcome.

Linen and towels

• All bed linen and towels are provided for the number in your party. When the rental period is for more than one-week access will be required on the middle Saturday to change the bed linen and towels.
• You are requested to supply your own pool towels.

Electricity and water

• Normal consumption of electricity and water is included in the rental. In cases of extra-ordinarily high consumption we will charge you 0.10 Euro per KWH.

Rubbish

• Rubbish should be deposited in the container/skip to the front of the main house. You can deposit your glass in the glass bin provided.

Swimming Pool

• No diving
• Clients are responsible for the supervision and safety of their party at all times when using the pool facilities.

Environmental conservation

• Respect for the environment is expected at all times. It is strictly forbidden to damage nature around the property.
• Caution - you should take extreme care when lighting the barbecue. You may only light a barbecue in the designated areas.

Liability

The Owner shall not be liable to the Client:

• For the temporary defect or stoppage in the supply of public services to the Property, nor in respect of any equipment, plant, machinery or appliances in the property or garden.
• For any loss, damage or injury that is the result adverse weather conditions, riot, war, strikes or other matters beyond the control of the Owner.
• For any loss, damage or inconvenience caused to or suffered by the Client if the property shall be destroyed or substantially damaged before the start of the rental period and in any such event, the Owner shall, within seven days of notification to the Client, refund to the Client all sums previously paid in respect of the rental period.
• Under no circumstances shall the Owners liability to the Client exceed the amount paid to the Owner for the rental period.

Applicable law

• This contract shall be governed by English law in every particular including formation and interpretation, and shall be deemed to have been made in England. Any proceedings arising out of or in connection with this contract may be brought in any court of competent jurisdiction in England.

Insurance

• The Client is strongly advised to arrange a comprehensive travel insurance policy (including cancellation cover) and to have full cover of his party's belongings, public liability etc. since these are not covered in the lessor's insurance.

Caretaker

• The caretaker, like the Owner, is always allowed entry to the property whenever they deem convenient.
• The caretaker, like the Owner is entitled to cancel the rental contract with immediate effect in case the Client or his party does not behave in an acceptable manner. In such an event the Owner or his caretaker cannot be held responsible under any circumstances for restitution of any amounts paid to him.
